Brazil’s Supreme Court has ordered a suspension of access to X, affecting over 200 million citizens, amid an ongoing clash between platform owner Elon Musk and Judge Alexandre de Moraes. The dispute intensified after Moraes launched an investigation into X, following Musk’s refusal to comply with previous court orders to block accounts linked to former President Jair Bolsonaro, accused of spreading misinformation and hate speech. Brazilian internet providers and app stores have been given five days to enforce this ruling.
Free Speech vs. Legal Compliance
In response to the court’s decision, Musk took to X, asserting that “Free speech is the bedrock of democracy” and criticizing Moraes as a “pseudo-judge” attempting to manipulate the system for political purposes. Additionally, X currently lacks a legal representative in Brazil to communicate with the government, a gap that emerged after the platform closed its Brazilian offices following threats against its previous legal representative. A crucial deadline to appoint a new representative has passed without action.
Potential Fallout and Legal Challenges
X’s global affairs team has expressed concern over the impending suspension, arguing that the ongoing legal proceedings conflict with Brazilian law. Despite the suspension order, users in major cities like São Paulo and Rio de Janeiro seem to still access X, although using a VPN could result in heavy fines. Moreover, Moraes has frozen the bank accounts of Starlink, Musk’s satellite internet service, due to its connection to X’s legal issues. Starlink plans to challenge these actions, calling them baseless. As Brazil moves forward with enforcing the suspension, this situation highlights the growing tension between regulatory frameworks and tech giants on a global scale.
